These terms and conditions outline the rules and regulations for the use of Sunscape’s Website, located at sunscapedxb.com.
Definitions:
Representation and Limitation of Liability:
Both parties represent and warrant that they have the power to enter into this agreement, which upon its execution, will constitute a valid and legally binding contract. The Company shall not be held liable for damages or losses, including personal injuries, incurred by The Guest as a result of the use of The Property. The Guest acknowledges and accepts responsibility for the safety of their personal assets and/or valuables. The Company shall not be held responsible for the loss of personal assets if The Guest fails to remove them before surrendering The Property.
General:
The Company will not be liable for any change or cancellation of any reservation caused, in whole or in part, by events beyond its control. Such events include, but are not limited to, acts of God, terrorist activities, weather, strikes, lockouts, riots, acts of war, earthquake, volcanic activity, ash clouds, tsunamis, fire, and explosions (Force Majeure).
The Website Policies and Terms & Conditions may be subject to change or updates to meet legal requirements and standards. Guests are encouraged to frequently visit these sections to stay updated about any changes on the website.
Minors:
Individuals under the age of 18 are not permitted to make a booking or stay in The Property without the presence of an adult.
Check-In & Check-Out:
Unless otherwise agreed, the standard check-in time is at 3 pm and check-out is by 11 am.
Reservations and services are deemed confirmed and guaranteed only upon:
– Receipt of all outstanding payments, including rent, security deposit, and all fees and taxes in full.
– Receipt of a confirmation email/sms sent by The Company to The Guest, containing the Booking/Reservation number and reservation details.
The Guest should inform the team in advance of any early check-in or late check-out request, which is subject to preapproval and unit availability.
Any unauthorized delay in the agreed check-out time will incur an extra charge.
Originals of acceptable and valid identification documents, such as Emirates ID and/or Passport, shall be presented during the check-in procedure by all Guests and visitors; otherwise, no entry will be granted.
Services & Facilities:
All properties are fully furnished and equipped with standard appliances, linen, bath, and kitchen utilities. Free high-speed internet and basic TV programs are included at no extra charge, as well as water and electricity consumption. Additional usage of Dewa, TV, or Chiller over its average monthly charge will be deducted from the security deposit. The average monthly charge is estimated based on previous years plus ten percent (10%). Any extra charges for TV (on-demand programs) will be billed and deducted from the security deposit.
During the stay, the necessary set of bed linen, bath towels, toiletries, toilet napkins, kitchen soap, and cleaning spray are provided at no extra charge and do not change during the stay unless ordered for an additional fee.
A fee will be charged for any long-distance calls/movies that are placed on the homeowner’s personal bill.
Guests will have access to the property’s facilities, including swimming pools and gyms when applicable, which are not considered private facilities with separate membership.
The Company cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, hot tubs, audiovisual equipment, computers, internet access, television, or appliances. Guests are requested to report any inoperative equipment to the company. The Company will make every reasonable effort to have repairs done quickly and efficiently. No refunds or rent reductions will be made due to the failure of such items.
In the event that The Property cannot be occupied due to unforeseen reasons not attributable to The Company, The Company reserves the right to substitute the original accommodation with another of the same or superior characteristics, without any additional payment.
Information regarding individual rental properties is believed to be accurate but cannot be guaranteed. Particular furnishings and amenities are subject to change without notice.
Cleaning Fee:
A one-time cleaning fee of AED 250 is collected within the rental payment. Additionally, for any additional change of towels, the fee is AED 50 per bathroom, and for the change of sheets, it is AED 75 per bedroom. Moreover, one complimentary cleaning service is offered for every 10 continuous nights’ stay.
The Guest may request extra cleaning services, including towel replacement, bed sheet setup, apartment cleaning, and replenishment of toilet amenities for the following fees:
Refundable Security Deposit:
A refundable security deposit will be retained to serve as insurance against any damage, misuse of The Property, or to cover any incidental use of facilities, replacement of broken items, or additional cleaning, in addition to the rent.
Upon inspection of The Property by The Company, the security deposit will be refunded in whole or in part within 7-14 business days.
The security deposit may be utilized for the following purposes:
1st complaint: full amount of damage deposit will be collected.
2nd complaint: The Guest will be evacuated from The Property.
If the Security Deposit is insufficient to cover damages resulting from the activities of The Guest, it is agreed that The Guest shall pay any undisputed difference within three (3) working days upon receipt of the request letter/email. This communication will include documentation evidencing the damage, as well as receipts, invoices, and other pertinent information regarding the actual repair costs. The Company will determine the actual repair/replacement cost plus 20% of the repair/replacement cost.
The term “Furniture” includes furniture, fixtures, supplies, decorative lights, utensils, linen, electronic equipment, fittings, paint, wall art, mattresses, and other relevant items.
Emergencies:
In case of any emergency, including fire, security issues, or health-related matters, it is essential for guests to promptly contact the appropriate emergency responders. The following emergency numbers should be utilized:
The safety and well-being of our guests are of paramount importance, and contacting the relevant emergency services without delay is crucial in addressing any unforeseen emergencies. It is our priority to ensure that guests have swift access to the necessary assistance in critical situations.
No Liability Undertaking:
The Guests are required to exercise caution around sharp items, electricity, fixtures, balconies, and any other potentially hazardous items. The Company or property owner will not be held liable in the event of injury to personnel due to negligence. It is the guest’s responsibility to ensure their own safety and that of the individuals accompanying or visiting them while staying in our property.
Prohibition of Property Subleasing or Sale:
The Guest shall not sublease, sublet, rent, or sell the property, nor engage in any activity amounting to subleasing, subletting, renting, or the sale of the property. This agreement does not transfer ownership of any assets from The Company to The Guest under this agreement.
Maintenance of Property Structure:
The Guest shall not drill, break, or make any structural changes to The Property, whether in part or in whole. Any alterations to The Property’s structure require explicit consent from the property management.
Limitation of Liability for Illegal Activities:
The company does not assume any liability or responsibility for any illegal activities performed by the guest, or for any activities other than those for which the property was intended.
The Guest agrees to indemnify and hold The Company harmless for any liabilities arising from, but not limited to, loss, theft, or damage to personal belongings, as well as any injury, illness, sickness, or death to The Guest or Visitors. Under no circumstances, including substitutions, will The Company be liable to refund any unused portion of booked accommodations or services. In the event of a catastrophic event such as a hurricane, tornado, earthquake, flood, fire, or other circumstances beyond The Company’s control, resulting in the impairment of the vacation rental, The Company is not responsible for arranging alternate lodging or for any financial losses related to transportation or alternate accommodation. Refunds or credits will not be issued for emergency or other evacuation scenarios.
Furthermore, the Guest(s) expressly agree to indemnify and hold harmless the Property Owner and The Company from any liabilities, theft, damage, costs, or expenses arising from or related to any claim or litigation resulting from the Guest(s) use and occupancy of the rental property. This includes, but is not limited to, any claims or liabilities for personal injury, property damage, or theft incurred or sustained by the Guest(s).
Legal activities:
The Property is solely designated for habitation purposes. Any suspicious activities, including but not limited to subleasing or any attempts to sublease The Property, will be reported to the authorities and law enforcement agencies. Engagement in such activities will result in the immediate termination of the contract without any refunds of paid dues.
All matters pertaining to the Website, as well as these Terms and Conditions, and any dispute or claim arising from or related to the same, including non-contractual disputes or claims, shall be governed by, and construed in accordance with, the laws in force in the Emirate of Dubai, United Arab Emirates, without giving effect to any choice or conflict of law provisions or rules, whether of the United Arab Emirates or any other jurisdiction.
Lost and found:
The Company does not accept liability for any lost or stolen personal items of The Guest. Additionally, we are not liable for any damages incurred by personal items. In the event that The Guest inadvertently leaves personal belongings in The Property, we kindly request immediate notification from The Guest.
If the inadvertently left items can be located, we will work with The Guest to arrange the most suitable method for returning the items. Any applicable courier charges will be billed to The Guest.
Payment tariffs and fees:
All payments for the full rental period must be settled well in advance before The Guests move into The Property. As per the Dubai Tourism & Marketing Authority, Dubai Tourism fees are applicable and are to be borne by The Guest. These fees are limited to the first 30 nights of the stay, as specified by the Dubai Tourism & Marketing Authority (DTCM).
For longer stays, each reservation is valid for a maximum period of 3 months, as per the DTCM. Upon renewal of the reservation period, the Tourism Dirham Fee (TDF) will apply again for the new reservation. The Tourism Dirham Fee amounts to AED 10 for standard holiday homes and AED 15 for deluxe holiday homes per booked room per night, as per the Executive Council Resolution No. (2) of 2014.
In compliance with UAE law effective from January 1st, 2018, a 5% VAT (Value Added Tax) will be implemented in addition to the tourism fees, to be collected at the time of check-in.
Payments are to be made in AED, the local currency of The Company. Exchange rates and associated fees may vary depending on the card issuer.
In case of losing The Property key or access cards, the following fees are applicable:
Unauthorized smoking within The Properties or having furry family members (pets) will result in an additional cleaning charge of AED 2 000 per stay, in addition to any damage charges caused by The Guest during the stay.
All damages reported by housekeeping, including stained towels/linens caused by misuse, will be deducted from The Guest’s security deposit. Please handle all items with care.
Paid bookings, Cancellations & No Show:
According to our policy, there will be no refunds for cancellations made within 14 (fourteen) days prior to the check-in date. It’s important to note that any amendments to the booking may result in a change in the rate.
In the event of a no-show, the full value of the booking, which is 100%, will be charged.
If The Guest desires to extend their stay and the requested dates are available, they may request an extension by sending an email or making a call.
Code of conduct and behavior:
The Guests are kindly requested to adhere to civilized behavior while staying at our The Property and are expected to show consideration to their neighbors and avoid causing any inconvenience. Parties with loud music and excessive noise are strictly prohibited. The Guests have the right to host outside visitors in The Property, who are also expected to comply with the code of conduct and behave in a civilized manner as per the community rules. Certain The Properties do not permit unregistered guests to enter. Registration is mandatory and subject to approval.
The maximum number of overnight guests for The Property is clearly defined and indicated as per the reservation. The occupancy for The Property must not exceed this limit at any time. If The Guest surpasses the maximum occupancy, both The Guest and their visitors are subject to immediate removal and may forfeit their security deposit and rental payment.
The furniture, bedding, mattress pads, utensils, or any other items provided within the rental property must not be removed or transferred to another property. Any loss of these items, as well as damage to The Property or furnishings beyond normal wear and tear, will be charged to The Guest.
All waste must be disposed of in sealed plastic bags and placed inside the garbage chute available on the apartment floor. It should not be left in corridors or on the floor of the garbage room.
When absent from The Property, The Guest is required to close and lock all windows and doors to maintain security and prevent dust, rain, and water damage.
Barbecues are not permitted inside ANY Property, including its balconies or terraces, and are only allowed in designated areas.
Both The Guests and their visitors are expected to park only in the designated area(s) and adhere to the maximum number of vehicles as instructed by The Company.
Payment Services:
When utilizing the Payment Services, certain information will be collected. Upon signing up for an account, we will require specific details such as your first name, last name, email address, and date of birth. Additional information, such as your address, phone number, and copies of your passport or Emirates ID, will be requested during the booking process. Moreover, financial information, including your bank account or credit card details, will also be required.
Please be aware that we are consistently implementing and updating administrative, technical, and physical security measures to safeguard your information against unauthorized access, loss, destruction, or alteration.
In the event that you are aware or have reason to believe that your account credentials have been lost, stolen, misappropriated, compromised, or if there is any actual or suspected unauthorized use, we kindly ask you to contact us immediately. Your proactive communication in such instances will assist us in taking the necessary steps to address and rectify the situation effectively.
Repairs and Maintenance:
The Company shall not be held liable for unfavorable weather conditions, acts of God, disruption of utility services, or the malfunction or breakdown of appliances or other equipment and services, such as TV, cable channels, internet, AC service, and lighting. Additionally, the limitations or restrictions imposed by government or community authorities on the use of amenities like the pool, gym, or other facilities are also beyond the company’s control.
In the event of any repair or maintenance issues, all relevant communications will be handled by the dedicated The Company team during operational working hours from 9:00 am to 6:00 pm, Monday to Saturday. For urgent matters please contact us at +971581715542.
